The applicant in lieu of moving <br />the existing building cannot <br />provide the required 40 foot front <br />yard setback. <br />5. The proposed driveways are within <br />the standard widths. <br />6. The plans indicate that the pro- <br />posed building has standard concrete <br />block on the street side of the <br />building which matches the <br />existing building and expands an <br />existing non-conformity. <br />7. Concrete curbing is not depicted <br />on the site plan. <br /> <br />STAFF COMMENTS <br /> <br />To better meet the intentions of the non-conforming use permit (Section <br />3-60) the site plan should be revised to provide for: <br /> <br />1. Concrete curbing from the street to the front building line; <br />2. Remove the two parking spaces that extend into the front yard; <br />3. Revise the side interior yard parking to provide for the <br />required 13 spaces with one being 12' x 20' for handicapped <br />parking; <br />4. Rev~se landscape plan to denote all existing front yard land- <br />scaping (the front yard has numerous existing plantings with <br />crushed rock and is not sodded as indicated on the plan). <br />5. Revise the area noted as gravel parking to indicate location <br />and number of vehicles and also provide for an adequate dustless <br />surface. <br />6. The northern most driveway should be altered to continue straight <br />to the east and not be brought to the building, as it appears <br />there could be parking in that side street yard. <br /> <br />Staff contends that with these minor revisions the plans would meet <br />the intention of the non-conforming use permit. Since the revisions <br />are minor staff feels that the Board can take action on the plans as <br />presented with conditions for the revisions. <br /> <br />In regard to the building permit request the plans are complete and <br />contain all necessary information. Action on the building permit should <br />be contingent on grading and drainage plans being approved by the Rice <br />Creek Watershed District. <br /> <br />STAFF RECOMMENDATION <br /> <br />Staff recommends that the Board recommend approval of NC-48 by waiving <br />the reading and adopting the resolution with conditions. <br />
