<br />RESOLUTION NO <br />NEW BRIGHTON PLANNING COMMISSION <br />BOARD OF REVIEW <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL <br />OF NON-CONFORMING USE PERMIT, NC-48 <br /> <br />WHEREAS, An application for a non-conforming use permit, <br />NC-48 has been made by Stan's Truck Refrigeration Service, <br />Inc. <br /> <br />WHEREAS, The procedural history of the application is <br />as follows: <br /> <br />1. That an application for a non-conforming use permit <br />was filed with the City on October 14, 1980. <br />2. That the Board of Review heard and reviewed the <br />application at its regular meeting on October 21,1980. <br />3. The written comments and analysis of the City Planner <br />and all person's statements made at the Board of <br />Review meeting were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED By the Board of Review <br />that the following Findings of Fact are made in respect <br />to NC-48: <br /> <br />1. That the property is zoned 1-1 Light Industrial. <br />2. That these are the following existing Type IV Non- <br />conformities: <br />A. Front yard parking; <br />B. Side street yard parking; <br />C. Lack of dustless surface; <br />D. Less than the required 40 foot front yard <br />setback; <br />E. Driveways which exceed the maximum width; <br />F. Inadequate exterior wall treatment on the street <br />sides of the building; and <br />G. Lack of required concrete curbing; <br />3. That the applicant will address the non-conformities <br />being providing the following: <br />A. Eliminate front yard parking and side street <br />yard car parking; , <br />B. All driving and car parking areas will be paved <br />with asphalt; <br />C. The two driveways will meet width requirements; <br />and <br />D. The required concrete curbing will be installed. <br /> <br />BE IT FURTHER RESQ~VED, That the Board of Review <br />recommends approval of~~48 contingent on the following: <br /> <br />1. The required concrete curbing is installed; <br />2. Remove the two parking spaces that extend into <br />the front yard; <br />3. Revise the side interior yard parking to provide <br />for the required 13 spaces with one being <br />121 x 20' for handicapped parking; <br />4. Revise landscape plan to denote all existing front <br />yard landscaping; <br /> <br />. <br />
