<br />RESOLUTION NO <br /> <br />STATE OF .MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APP~ICATION FOR <br />NON-CONFORMING USE PERMIT, NC-48 <br /> <br />,.. <br /> <br />WHEREAS, An application for a non-conforming use permit <br />entitled NC-48 has been made by Stan's Truck Refrigeration <br />Service to permit the construction of an addition to an <br />industrial site with existing TYfJeIV non-c-onformitie~,-and <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. That an application for non-conforming use permit was <br />filed with the City of New Brighton on October 14, 1980. <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on October 21, 1980. <br />3. That the City Council, pursuant to published and mailed <br />notices, held a public hearing on November 12, 1980, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />4. The written comments and analysis of the tity staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />NC-48: <br /> <br />1. That the property is zoned 1-1, Light Industrial. <br />2. That these are the following existing Type IV <br />Non-conformities: <br />A. Front yard parking; <br />B. Si des t reet ,yard~arki-ng; <br />C. Lack of dustless surface; <br />D. Less than the required 40 foot f~on~ yard <br />setback; <br />E. Driveways which exceed the maximum width; <br />F. Inadequate exterior wall treatment on the <br />street sides of the building; <br />G. Lack of required concrete curbing; <br />H. Storage of trucks exceeding 6 feet in height <br />that are not s~tback forty feet nor screened <br />from the public right-of-way; <br />I. Three driveways, one of which does not access <br />off of a public street; and <br />J. More than 'One overhead door facing a public <br />street and the doors are not the required <br />50 feet from the right-of-way. <br />3. That the applicant addresses the non-conformities <br />by providing for the following: <br />A. Eliminate front yard parking and side street <br />yard car parking; <br />B. All driving and car parking areas will be <br />paved with asphalt; <br />C. The driveways will meet width requirements; <br />D. The required concrete curbing will be installed; <br />and <br />E. Truck storage areas will be of a dustless surface. <br /> <br />. -,' <br />. " <br /> <br />. <br />
