<br />I' <br /> <br />..' -~' ,~ <br /> <br />1.~\ <br /> <br />RESOLUTION NO <br /> <br />84-158 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br />VN-238, for a less than required side street yard setback. <br /> <br />WHEREAS, an application for a variance has been made by John <br />and Melanie Lawson; and <br /> <br />:i WHEREAS, the procedural history of the application is as <br />, follows: <br /> <br />I 1. That an application for a variance was filed with the <br />City on September 28, 1984. <br />2. That the Planning Commission, pursuant to published <br />and mailed notices, held a public hearing on October 16, <br />1984, all person's present at the hearing were given <br />an opportunity to be heard. <br />3. That such application was reviewed by the City Council <br />on October 23, 1984. <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations were <br />considered. <br />5. That the deck replaces an existing deck. <br />6. That since the deck was a replacement of an existing <br />deck the applicant would have been permitted to repair <br />the existing deck up to 50 percent of its current value <br />without a permit from the City. <br /> <br />WHEREAS, the legal description of the property is as <br />follows: <br /> <br />.' <br />., <br /> <br />Lot 1, Block 4, Oakwood Manor Terrace <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />VN-238 : <br /> <br />1. That the property is zoned R-l. Single Family Residential~ <br />2. That the required side street yard setback for the deck . <br />is uncertain under Section 4-580(b) of the zoning code. <br />3. That the applicant is requesting a zero side street yard <br />setback. <br />4.
