<br />;.: <br />'1 <br /> <br />RESOLUTION NO. 84-153 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />,,' <br /> <br />...~ ~ <br />'II <br /> <br />RESOLUTION GRANTING THE GORDON RENDERING COMPANY AN OFFENSIVE <br />"TRADES LICENSE AND AFFIXING CERTAIN CONDITIONS OF OPERATION. <br /> <br /> <br />WHEREAS, the City of New Brighton is responsible for the <br />general safety, health, welfare and well-being of its residents <br />and has established codes to aid in carrying out this <br />responsibility; and <br /> <br />WHEREAS, City Code Chapter 24 entitled Sewer Department <br />Regulations and Chapter 15, Article VII, entitled Offensive, <br />Dangerous Trades, and Metropolitan Sewer Board Rules and <br />Regulations for the Metropolitan Disposal System and the <br />Minnesota Pollution Control Agency Regulations all apply to the <br />,operation of the Gordon Rendering Company as a renderingbusinessl; and <br /> <br />WHEREAS, the City is aware and has been informed that certain <br />, deficiencies in the operation of the Gordon Rendering Company's <br />old plant have occurred in the past with respect to these codes, <br />rules, regulations and standards and could dccur with the new <br />plant; and <br /> <br />WHEREAS, these deficiencies when they have occurred, have <br />affected the safety, health, welfare and well-being of the City's <br />residents in that they have caused plugging of the sanitary sewer <br />i and lift stations, interference with sanitary sewer service to <br />others, dumping of raw sewage on the open ground and/or often <br />resulted in offensive odors in the neighborhood; and <br /> <br />WHEREAS, on April 24, 1984 a stack emission test, in con- I <br />formance with American Society for Testing Materials Method (ASTH)! <br />i; 0 - 1 39 7 - 5 7, was perf 0 r m e don t he em i s s ion from the s t a c k 0 f the i <br />" s c rub b e r s e r v i n g the Go r don Rend e r i n g Com pan y p 1 ant fa c i 1 i tie sat <br />19-14th Street NE and such test indicated an average odor level <br />of 8.9 odor units per cubic foot and a total emission rate of <br />,289,500 odor units per minute. These figures are less than the <br />limit of 150 odor units allowed and less than one million odor <br />units per minute allowed by APC-9; and <br /> <br />WHEREAS, a second emission test was performed on October 15, <br />1984, which indicated an average odor level of 18.0 odor units <br />per cubic foot and a total emission rate of 560,000 odor units <br />per minute. These figures are less than the limit of 150 odor <br />units per minute allowed and less than one million odor units <br />per minute allowed by APC-9; and <br /> <br />NOW THEREFORE BE IT RESOLVED, that the Offensive Trades <br />License of the Gordon Rendering Company be granted under the <br />,following conditions: <br /> <br />1. All doors and windows shall be kept closed during <br />periods of operation so that all rendering plant <br />air will be processed through a scrubber, except <br />during periods of loading and unloading when loading <br />doors may be open but these periods shall be kept <br />to a minimum. <br /> <br />2. The Gordon Rendering Company shall continue to perform <br />all obligations required of it by its agreement with <br />the City of New Brighton dated January 25, 1977 and as <br />amended by an agreement dated December 12, 1978. <br /> <br />3. That any plugging or impairment of the operation of <br />the City sewer system with grease will be considered <br />prima facia evidence that Section 24-8 of the City Code, <br />Section 15-147 of the City Code, Article V, Section <br />5-4A of the Rules and Regulations for the Metropolitan <br />Sewer Disposal System have been and are being violated <br />and that the right of the rendering plant to use the <br />City Sewer system is thereby immediately suspended. <br />The amount of grease discharged into the City sewer <br />system shall be 100 mg. per liter or less.
