I', <br /> <br />. . <br /> <br /> <br />,': ~rl. <br />'~~ <br /> <br />RESOLUiION NO. 86-13 <br />NEW 8RIGHTON PLANNING COMl1ISSIO:1 <br /> <br />RESOLUTION flAKING FINDINGS OF FACT AlID RECOt~1EtIOING APPROVAL OF NC-7l. <br /> <br />i <br /> <br />WHEREAS, an application for a nonconforming use permit has been <br />made by Chenoweth Greenhouses; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That an application for a nonconforming use permit was filed with <br />the City on July II. 1986. <br /> <br />2. lhat the Planning Commission, pursuant to publiShed and mailed <br />notices, held a public hearing on July IS, 1986, all persons present <br />at the hearing were given an opportunity to be heard. <br /> <br />11011 THEREFORE BE Ir RESOLVED by the Planning Commission that the <br />following Findings of Fact are made in respect to IIC-7I. <br /> <br />1. That the site is zoned I-I, light industrial. <br /> <br />2. That the site has the following type IV nonconformities: <br /> <br />a. Less than required 15 foot side yard setback. <br />b. Less than required 40 foot front yard parking and <br />garden center setback. <br />c. Lack of concrete curbing in a portion of frunt yard <br />parking area. <br />d. Less than required parking. <br />e. Lack of front yard landscaping. <br /> <br />3. That the applicant has shown the total number and extent of the <br />nunconformities will be addressed as follows: <br />a. Provide additional parking that will meet the required <br />parking except for three months of the year. <br />b. Complete the curbing around all front yard parking areas. <br />c. Increase the side yard setback to 21 feet over 93 feet of the <br />existing nonconforming setback. <br />d. Reduce the size of the temporary garden center. <br /> <br />4. That the applicant has done everything practical to reduce the <br />existing Type IV nonconformities at this time. <br /> <br />BE IT FURTHER RESOLVED that the application IIC-71 is and hereby <br />recommended for approval subject to approval of LP-201. <br /> <br />Adopted this 15th day of July, 1986. <br /> <br />Larry Baker, ChaIrman <br /> <br />.
