<br />;1 <br />II <br /> <br />~ <br /> <br />~ <br /> <br />~ <br /> <br /> <br />'RESOLUTION NO. 84-152 <br />STATE OF MINNESOTA <br />COUNTY OR RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION GRANTING THE MENGELKOCH COMPANY AN OFFENSIVE TRADES <br />LICENSE AND AFFIXING CERTAIN CONDITIONS OF OPERATION. <br /> <br />WHEREAS, the City of New Brighton is responsible for the <br />general safety, health, welfare and well-being of its residents <br />and has established codes to aid in carrying out this <br />responsibility; and <br /> <br />WHEREAS, City Code Chapter 24 entitled Sewer Department <br />,Regulations and Chapter 15, Article VII, entitled Offensive, <br />Dangerous Trades, and Metropolitan Sewer Board Rules and <br />Regulations for the Metropolitan Disposal System and the <br />!,Minnesota Pollution Control Agency Regulations all apply to <br />the operation of the Mengelkoch Company as a rendering business; <br />and <br /> <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />WHEREAS, on January 31, 1984, a stack emission test, in I <br />conformance with American Society for Testing Materials Method I <br />(ASTH) 0-1397-57, was performed on the emission from the stack I <br />of the Mengelkoch Company plant facilities at ll9-17th Street NE I <br />and such test indicated an average odor level of 17.0 odor units i <br />per cubic foot, which is below the limit of 150 odor units allowed <br />by APC-9. Further, that the test indicated a total emission rate <br />of 381,400 odor units per minute which is within the limit of one <br />. million odor units per minute allowed by APC-9; and <br /> <br />WHEREAS, the City is aware and has been informed that <br />certain deficiencies in the operation of the Menge1koch Company <br />have occurred in the past with respect to these codes, rules, <br />regulations and standards; and <br /> <br />WHEREAS, the deficiencies which previOUSly existed in <br />regard to disposal of sewage have, in the past, affected the <br />safety, health, welfare and well-being of the'City.s residents <br />in that such deficiencies cause plugging of the sanitary sewer <br />: and lift station, interference with sanitary sewer service to <br />i others, dumping of raw sewage on the open ground, and emission <br />: of offensive odors in the neighborhood; and <br /> <br />;; <br /> <br />WHEREAS, a second emission test was performed on June 26, <br />1984, which indicated an average odor level of 12.0 odor units <br />per cubic foot and a total emission rate of 263,000 odor units <br />per minute. These figures are less than the limit of 150 odor <br />units per minute allowed and less than one million odor units <br />per minute allowed by APC-9; and <br /> <br />NOW THEREFORE BE IT RESOLVED, that the Offensive Trades <br />License of the Mengelkoch Company for the premises at 119-14th <br />Street NE be granted under the following conditions: <br /> <br />1. All doors and windows shall be kept closed during <br />periods of operation so that all rendering plant <br />air will be processed through a scrubber, except <br />during periods of loading and unloading when loading <br />doors may be open but these periods shall be kept to <br />a minimum. <br /> <br />2. The Mengelkoch Company shall continue to perform all <br />obligations required of it by its agreement with the <br />City of New Brighton dated January 25, 1977, and as ' <br />amended by a subsequent agreement dated December 12,1978~ <br />I <br />3. That any plugging or impairment of the operation of <br />the City sewer system with grease will be considered <br />prima facia evidence that Section 24-8 of the City Code, i <br />Section 15-147 of the City Code, Article V, Section I <br />5-4A of the Rules and Regulations for the Metropolitan I <br />Sewer Disposal System have been and are being violated : <br />and that the right of the rendering plant to use the 1 <br />City sewer system is thereby immediately suspended. i <br />
