<br />RESOLUTlON NO. <br /> <br />STATE OF l'IIWJESOTA <br />COUNTY OF R,'\:1SEY <br />CITY OF NeW BRIG~,ON <br /> <br />RESOLUTION ~iAKING FINDINGS 02 FACT AND APPROVI:-JG AN APPLICATION <br />FOR VN-251 <br /> <br />WHEREAS, an applicaU'on for a variance entitled VN-251 has <br />been made by "'irst General Services to permit an office/warehouse building <br />and accessory parking to be located 40 feet from an R-3A, multi family <br />residential district; and <br /> <br />WHEREAS, the procedural history of the application is as <br /> <br />follows: <br /> <br />1. That an application for VN-25l was filed with the City of <br />New Br ighton on October 3f;l986. <br />2. 'i'hat the Planning Comnission, pursuant to publ ished and <br />mailed notices, held a public hearing on t.lovember 18, 1986, <br />all person's present at the hearing were given an opportunlty <br />to be heard. <br />3. That such application was reviewed by the City Council <br />on tJovember 25, 1986. <br />4. The wr i tten comnents and analysis of the Ci ty Staff, <br />Planning Calmission minutes and recornnendations were <br />considered. <br /> <br />NOW THEREFOR!: BE IT RESOLVED, that the New Brighton Ci ty <br /> <br />1. That the property is zoned I-I, light industrial. <br />2. That the property directly to the south is zoned R-3A, <br />multiple family residential. <br />3. That section 6-060(c) states that an industrial district <br />sideyard adjacent to a residential boundary line shall <br />provide for a 60 foot landscaped area to provide screening. <br />4. That the applicant is requesting a 20 foot variance along the <br />south property line. <br />5. rhat the site is long and narrow, slopes to the east, is <br />partially located in the floodplain, and has poor soils <br />which combine to restrict the buildable area of the site. <br />6. That the requirement for a 60 foot landscaped strip along the <br />south property line further reduces the buildable area of an <br />already narrow site. <br />7. That the existing apartment building is located approximately <br />40 feet from the south property line of the proposed <br />development (80 feet from the proposed new structure). <br />8. That the applicant will suffer undue hardship if the variance <br />be sufficlent to construct an industrial building and drive <br />access, and off-street parking. <br />9. That the applicant has demonstrated unique and unusual <br />circunstances and undue hardship for the variance request. <br /> <br />BE IT FURTHER RESOLVED, that the application VN-251 is hereby <br />approved subject to the following conditions: - <br /> <br />1. Approval of LP-204. <br />2. That all grading and drainage plans be approved by the City <br />Engineer. <br />l ;;'That a six foot cyclone fence be constructed according to <br />~ code along the south property line. <br /> <br />Adopted this 25th day of November, 1986. <br /> <br />Robert J.
