EASEMENr AGREEMENr This Easement Agreement is made by and between Belair Corporation, a Minnesota corporation (hereinafter referred to as "Grantor") and the City of New Brighton (hereinafter referred to as "Grantee.") WITNESSETH WHEREAS, Grantor is the owner of a tract of land described as follows: That part of the Southwest 1/4 of the Northeast 1/4 of Section 32, Township 30 North, Range 23 West, Ramsey County, Minnsota, described as follows to-wit: Beginning at the Northwest corner of said Southwest 1/4 of the Northeast 1/4; thence South along the Westerly line a distance of 190 feet thence at right angles Easterly a distance of 385 feet: thence at right angles Northerly a distance of 130 feet; thence at right angles Westerly a distance of 35 feet; thence at right angles Northerly to the North line of said Southwest 1/4 of the Northeast 1/4; thence Westerly along said North line to the point of beginning. WHEREAS, the Grantor desires to grant unto the Grantee a perpetual easement for water ponding and water flowage over, on and across the following described easement tract: The South 130 feet of the East 50 feet of that part of the Southwest 1/4 of the Northeast 1/4 of Section 32, Township 30 North, Range 23 West, Ramsey County, Minnesota, described as follows to-wit: Beginning at the Northwest corner of said Southwest 1/4 of the Northeast 1/4; thence South along the Westerly line a distance of 190 feet; thence at right angles Easterly a distance of 385 feet; thence at right angles Northerly a distance of 130 feet; thence at right angles Westerly a distance of 35 feet; thence at right angles Northerly to the North line of said Southwest 1/4 of the Northeast 1/4; thence Westerly along said North line to the point of beginning. NOW, THEREFORE, the following grants, covenants and restrictions are made for valuable consideration, the receipt and sufficiency of which are hereby acknowledged. 1. Grantor hereby grants to Grantee, its successors or assigns, a perpetual easement for water ponding and water flowage on, over and across the Easement Tract. 2. All of the provisions of this instrument, including the benefits and burdens, run with the land and to the benefit of the Grantee, its successors or assigns.
