<br />~ <br /> <br />.... <br /> <br />EASEMENr AGREEMENr <br /> <br />This Easement Agreement is made by and between Belair <br />Corporation, a Minnesota corporation (hereinafter referred to as <br />"Grantor") and the City of New Brighton (hereinafter referred to <br />as "Grantee.") <br /> <br />WITNESSETH <br /> <br />WHEREAS, Grantor is the owner of a tract of land described <br />as follows: <br /> <br />That part of the Southwest 1/4 of the Northeast 1/4 of <br />Section 32, Township 30 North, Range 23 West, Ramsey County, <br />Minnsota, described as follows to-wit: <br /> <br />Beginning at the Northwest corner of said Southwest 1/4 of <br />the Northeast 1/4; thence South along the Westerly line a <br />distance of 190 feet thence at right angles Easterly a <br />distance of 385 feet: thence at right angles Northerly a <br />distance of 130 feet; thence at right angles Westerly a <br />distance of 35 feet; thence at right angles Northerly to the <br />North line of said Southwest 1/4 of the Northeast 1/4; <br />thence Westerly along said North line to the point of <br />beginning. <br /> <br />WHEREAS, the Grantor desires to grant unto the Grantee a <br />perpetual easement for water ponding and water flowage over, on <br />and across the following described easement tract: <br /> <br />The South 130 feet of the East 50 feet of that part of the <br />Southwest 1/4 of the Northeast 1/4 of Section 32, Township <br />30 North, Range 23 West, Ramsey County, Minnesota, described <br />as follows to-wit: <br /> <br />Beginning at the Northwest corner of said Southwest 1/4 of <br />the Northeast 1/4; thence South along the Westerly line a <br />distance of 190 feet; thence at right angles Easterly a <br />distance of 385 feet; thence at right angles Northerly a <br />distance of 130 feet; thence at right angles Westerly a <br />distance of 35 feet; thence at right angles Northerly to the <br />North line of said Southwest 1/4 of the Northeast 1/4; <br />thence Westerly along said North line to the point of <br />beginning. <br /> <br />NOW, THEREFORE, the following grants, covenants and <br />restrictions are made for valuable consideration, the receipt and <br />sufficiency of which are hereby acknowledged. <br /> <br />1. Grantor hereby grants to Grantee, its successors or <br />assigns, a perpetual easement for water ponding and water flowage <br />on, over and across the Easement Tract. <br /> <br />2. All of the provisions of this instrument, including the <br />benefits and burdens, run with the land and to the benefit of the <br />Grantee, its successors or assigns. <br />
