, i .i CHAPTER X. FLOODPLAIN MANAGEMENT SECTION 10-010 Statut"bry authorization, findings of fact and purpose. a. Statutory Authorization. The Legislature of the State of Minneso~a has in Minnesota Statutes 1969, c. 104, delegated the responsibility to local governmental units to adopt regulations designed to minimize flood losses. Therefore, the Council of the City of New Brighton, Minnesota, does ordain as follows: b. Findings of Fact. (1) The flood hazard areas of New Brighton, Minnesota, are subject to periodic inundation which results in potential loss of life, loss of property, health and safety hazards, disruption of commerce and governmental services, extra-ordinary public expenditures for flood protection and relief, and impairment of the tax base, all of which adversely affect the public health, safety and general welfare. (2) Methods used to analyze flood hazards. This chapter is based upon a reasonable method of analyzing flood hazards which is consistent with the standards established by~ the MinBesota Department of Natural Resources. c. Statement of Purpose. It is the purpose of this chapter to promote~ the public health, safety, and general welfare and to minimize those losses described in section b.l. above by provisions contained herein. SECTION 10-920 General ProvisiONS. a. Lands to Which Chapter A~plies. This Chapter shall apply to all lands within the jurisdiction of the City of New Brighton showe on the Official Floodplain Zoning Map as being located within the boundaries of the Floodway, Flood Fringe, or General Floodplain Districts. b. Establishment of Official Floodplain Zoning Map. The Official Flood Plain Zoning Map together with all explanatory materials thereon, and attached thereto is hereby adopted by reference and declared to be part of this chapter. The explanatory material shall include the Flood Insurance Study for the City of New Brighton prepared by the Federal Insurance Administration dated March, 1978, the Flood Boundary and Floodway Maps and Flood Insurance Rate Maps therein and Flood Plain Information, Mississippi River and Rice Creek, Fridley and New Brighton, Minnesota, United States Army Corps of Engineers, St. Paul District, November, 1971. The Official Flood Plain Zoning Map shall be on file in the office of the city clerk and the director of community deve19pment.
