<br />, <br />i <br />.i <br /> <br />CHAPTER X. FLOODPLAIN MANAGEMENT <br /> <br />SECTION 10-010 Statut"bry authorization, findings of fact and purpose. <br /> <br />a. Statutory Authorization. The Legislature of the State of <br />Minneso~a has in Minnesota Statutes 1969, c. 104, delegated the <br />responsibility to local governmental units to adopt regulations <br />designed to minimize flood losses. Therefore, the Council of the <br />City of New Brighton, Minnesota, does ordain as follows: <br /> <br />b. Findings of Fact. <br /> <br />(1) The flood hazard areas of New Brighton, Minnesota, are subject <br />to periodic inundation which results in potential loss of <br />life, loss of property, health and safety hazards, disruption <br />of commerce and governmental services, extra-ordinary public <br />expenditures for flood protection and relief, and impairment <br />of the tax base, all of which adversely affect the public <br />health, safety and general welfare. <br /> <br />(2) Methods used to analyze flood hazards. This chapter is based <br />upon a reasonable method of analyzing flood hazards which is <br />consistent with the standards established by~ the MinBesota <br />Department of Natural Resources. <br /> <br />c. Statement of Purpose. It is the purpose of this chapter to <br />promote~ the public health, safety, and general welfare and to <br />minimize those losses described in section b.l. above by provisions <br />contained herein. <br /> <br />SECTION 10-920 General ProvisiONS. <br /> <br />a. Lands to Which Chapter A~plies. This Chapter shall apply to <br />all lands within the jurisdiction of the City of New Brighton showe <br />on the Official Floodplain Zoning Map as being located within the <br />boundaries of the Floodway, Flood Fringe, or General Floodplain <br />Districts. <br /> <br />b. Establishment of Official Floodplain Zoning Map. The Official <br />Flood Plain Zoning Map together with all explanatory materials thereon, <br />and attached thereto is hereby adopted by reference and declared to <br />be part of this chapter. The explanatory material shall include the <br />Flood Insurance Study for the City of New Brighton prepared by the <br />Federal Insurance Administration dated March, 1978, the Flood Boundary <br />and Floodway Maps and Flood Insurance Rate Maps therein and Flood <br />Plain Information, Mississippi River and Rice Creek, Fridley and <br />New Brighton, Minnesota, United States Army Corps of Engineers, St. <br />Paul District, November, 1971. The Official Flood Plain Zoning Map <br />shall be on file in the office of the city clerk and the director of <br />community deve19pment. <br />
