;1 <, \! RESOLUTION NO.84-140 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING NC-65. WHEREAS, an application for a non-conforming use permit has been made by Bell Lumber and Pole Company; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a non-conforming use permit was filed with the City on August 30, 1984. That the Planning Commission, pursuant to published and mailed notices, held a public hearing on September 18, 1984, all person's present at the hearing were given an opportunity to be heard. That the reouest was considered by the City Council , on September 25, 1984 and the staff analysis and Planningl Commission minutes and recommendation were considered. ! I 1 2. 3. NOW THEREFORE BE IT RESOLVED by the City Council that the following Findings of Fact are made in respect to NC-65. 1. i i I That the site has the following Type IV non-conformities~ a. Lac k 0 f s c r e e n i n g 0 f 0 u t sid est or age are a fro m . public right-of-way; b. More than the permitted number of curb cuts; c. Lack of dustless surface and concrete curbing on parking on drive areas; and d.Setback of outside storage materials from property boundaries. That the applicant has proposed to reduce the total number of non-conformities by screening the outside storage areas from the public right-of-way and planting grass on the boulevard between the curb line of the street and the technique screening used. That consideration of the non-conformities at a future date will be warranted if a non-conforming use permit is requested in the future. 2 . 3. BE IT FURTHER RESOLVED that the application NC-65 is and hereby approved subject to the following conditions: 1. That screening of the outside storage areas be completed; by means of the planting of five-foot evergreens at 10 ' foot intervals or by construction of an eight-foot wood fence made of treated pine boards woven vertically, or better. 2. That the applicant continue to implement dust control measures by adding crushed rock to parking and drive areas on the site. 3. That a fence or screening technique be setback the same distance from 1st Street NW as the MacGillis and Gibb's fence and that storage be permitted up to the fence line.
