<br />;1 <br /> <br /><, <br /> <br />\! <br /> <br />RESOLUTION NO.84-140 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING NC-65. <br /> <br />WHEREAS, an application for a non-conforming use permit <br />has been made by Bell Lumber and Pole Company; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. <br /> <br />That an application for a non-conforming use permit <br />was filed with the City on August 30, 1984. <br />That the Planning Commission, pursuant to published <br />and mailed notices, held a public hearing on September <br />18, 1984, all person's present at the hearing were <br />given an opportunity to be heard. <br />That the reouest was considered by the City Council , <br />on September 25, 1984 and the staff analysis and Planningl <br />Commission minutes and recommendation were considered. ! <br />I <br />1 <br /> <br />2. <br /> <br />3. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to NC-65. <br /> <br />1. <br /> <br />i <br />i <br />I <br />That the site has the following Type IV non-conformities~ <br />a. Lac k 0 f s c r e e n i n g 0 f 0 u t sid est or age are a fro m . <br />public right-of-way; <br />b. More than the permitted number of curb cuts; <br />c. Lack of dustless surface and concrete curbing <br />on parking on drive areas; and <br />d.Setback of outside storage materials from property <br />boundaries. <br />That the applicant has proposed to reduce the total <br />number of non-conformities by screening the outside <br />storage areas from the public right-of-way and planting <br />grass on the boulevard between the curb line of the <br />street and the technique screening used. <br />That consideration of the non-conformities at a future <br />date will be warranted if a non-conforming use permit <br />is requested in the future. <br /> <br />2 . <br /> <br />3. <br /> <br />BE IT FURTHER RESOLVED that the application NC-65 is and <br />hereby approved subject to the following conditions: <br /> <br />1. That screening of the outside storage areas be completed; <br />by means of the planting of five-foot evergreens at 10 ' <br />foot intervals or by construction of an eight-foot wood <br />fence made of treated pine boards woven vertically, or <br />better. <br />2. That the applicant continue to implement dust control <br />measures by adding crushed rock to parking and drive <br />areas on the site. <br />3.
