<br />~ <br /> <br />__1 <br />· DATE: <br />CASE: <br />SUBJECT: <br /> <br />APPLICANT: <br /> <br />February 16, 1988 <br />LP-225, NC~84, VN-262, SP-148 <br />Site Plan Review, Non-Conforming Use Permit, <br />Front yard Setback Variance, and Special Use Permit <br />Micom Corporation <br /> <br />,. <br /> <br />REQUEST <br /> <br />AppYWU / <br /> <br />To hold a public hearing and consider a request for site plan <br />review, non-conforming use permit, a front yard setback variance and <br />a special use permit to construct a two story office/production <br />building on a site having Type IV nonconformities, located less <br />than 40 feet from 8th Avenue NW right-of-way and having four <br />driveway entrances. <br /> <br />FINDINGS <br /> <br />Chapter VI, <br /> <br />Section 6-010 <br />Section 6-370(c) <br />Section 8-210 <br />section 8-460 <br /> <br />Light Industrial District <br />Special Use Permit <br />Variance <br />Type IV Nonconformities <br /> <br />Chapter VIII, <br /> <br />PAST ACTION <br /> <br />- On October 10, 1978, the Council approved NC-32 and LP-72 to <br />enclose a loading dock on the east side of the existing building. <br />The following was done to eliminate the existing Type IV noncon- <br />formities: <br /> <br />1. Removed front yard parking along Old Highway 8 and landscaped <br />the area. <br />2. Reduced the number of side street yard parking stalls along <br />5th Street NW and provided some landscaping. <br />3. Installed the required concrete curbing. <br />4. Moved the driveway along Old Highway 8 further from the <br />street intersection. <br /> <br />- On August 12, 1980, the Council approved NC-45 and LP-102 to <br />construct an industrial building. Approval was granted under the <br />condition the side street yard parking be removed at the time of <br />future construction. <br /> <br />- On December 27, 1983, the Council approved NC-58 and LP-152 to <br />construct a second floor addition on the building facing 5th <br />Street NW. No conditions were placed on the nonconforming use <br />permit and the side street yard parking was allowed to remain. <br />It was determined the applicant had done everything practical to <br />address the nonconformities. <br /> <br />- On November 25, 1986, the Council approved NC-77 and LP-202 to <br />construct a second story addition to the original office/ <br />industrial building.
