,

10,

DATE:
CASE:
SUBJECT:

May 17, 1988
LP-229, VN-265, NC-65, Street Vacation
Site plan review, setback variance, non-conforming use
permit, and the vacation of street right-of-way.
Jerry Ladd, precision Bilt Block

APPLICANT:

REQUEST

To hold a public hearing and consider a request to construct an .
addition on an existing industrial building with existing type IV
non~conformities. The addition and parking areas would require
setback variances. Also, the vacation of a portion of the 8th
AvenueNW right-of-way is requested.

STAFF COMMENTS

During the process of reviewing this application, staff discovered
the westerly 33 feet of 8th Avenue NW right-Of-way the applicant
wishes to vacate is the only piece of said right-of-way remaining.
The easterly 33 feet must have been vacated many years ago.

The City currently has water utility lines running beneath the
subject right-of-way. Also, the City is currently examining this
piece of right-of-way for development of a trail or walkway to the
southwest portion of New Brighton as part of the City's Greenway
Plan. Therefore, staff has indicated to the applicant the City
most likely would want to hold on to this right-of-way and not
vacate. The City's consultant Gair and Associates, who is
preparing the Greenway Plan, concurs with this position.

If the righ~-of-way is not vacated, the appli~~n}~~,gl~n. ~&ul<1~.9~7&,r ".4..Jf!v1
to be redeslgned. Due to these recent developm~n~s; tne apprlcan~ I
has requested the public hearing for LP-229, VN-265, NC-65, and the
street vacation be continued.

RECOMMENDATION

Motion to CONTINUE THE PUBLIC HEARING FOR LP-229, VN-265, NC-65,
AND STREET VACATION UNTIL THE JUNE 21, 1988 PLANNING COMMISSION
MEETING.

Erny Mattila, City Planner

EM/pb
