<br />I'i WHEREAS, an application for a Special Use permit has been made by the
<br />i applicants, Ted Becchetti and Rick Roth.

<br />II NOW THEREFORE BE IT RESOLVED, the Ci ty Council makes the fo 11 owi ng
<br />Ii Findings of Fact in respect to SP-153:

<br />Ii 1. The subject site is zoned R-3, Multiple Family Residential.
<br />d 2. Moving an apartment building onto a lot inan R-3B district requires
<br />,II Special Use permit approval.
<br />I 3. The proposed apartmentbuildi ng ,wquld ,cQmp ly. ;wi th the requi rements
<br />I of the Uniform Building Code prior to being occupied.
<br />!i 4. The proposed development will have a minimal impact on surrounding
<br />II 1 and uses.
<br />Ii 5. The site is separated from the single family homes to the northwest
<br />!i by an elevated railroad right-of-way., ,',
<br />i! 6. The establishment, maintenance or Qperations of the special use will
<br />Ii not be detri menta 1 to or endanger the publ.i c ,hea 1 th, safety, morals,
<br />!! comfort or general welfare. '
<br />it 7. The special use will not be injurious to the ruse and enjoyment of
<br />Ii other property in the immediate vicinity for.,the purposes already
<br />i! permitted. nor substantially diminish and impair property values
<br />I, within the neighborhood.
<br />!i 8. The establishment of the special use will not impede the normal and
<br />:, orderly development and improvement of the surroundi ng property for
<br />1'1 uses permitted in the district. "
<br />9. Adequate utilities, access roads, drainage and/or necessary
<br />d facil ities have been or are being provided. .
<br />i'l 10. The speci a 1 use shall in all other, respects, ,conform to the
<br />I, applicable regulations of the district in which it is located.
