<br />DECLARATION <br />CONDOMINIUM NUMBER <br /> <br />BYLAWS <br />OF <br />BRIGHnrooO TOWNUOMES - I CONDOMINIUMS <br /> <br />ARTICLE I <br />Plan of Unit Ownership <br /> <br />Section 1.1 Unit Ownership. The project, located on 10th Street <br />N.W. between 9th Avenue N.W. and 8th Avenue N.W., New Brighton, Minnesota, <br />and known as Brightwood Townhomes - I Condominiums is submitted to the <br />provisions of Minnesota Statutes, Chapter 515, and laws amendatory thereto. <br /> <br />Section 1.2 Bylaws Applicabilit~. The provisions of these Bylaws <br />are applicable to the project. (The term "project" as used herein shall <br />include the land.) <br /> <br />Section 1.3 Personal Application. All present and future owners, <br />tenants, future tenants, or their employees, or any other person that <br />might use the facilities of the project in any manner, are subject to the <br />regulations set forth in these Bylaws and to the Rules and Regulations <br />promulgated thereunder. The members of the Association shall consist of <br />all holders of an interest in the units. The mere acquisition or rental <br />of any of the units of the project (hereinafter referred to as "units") or <br />the mere act of occupancy of any of said units will signify that these <br />Bylaws and the provisions of any such rules and regulations are accepted, <br />ratified and will be complied with. <br /> <br />ARTICLE II <br />Voting, Majority of OwnersJ~uorum, Proxies <br /> <br />Section 2.1 VotinQ. Voting shall be on a percentage basis and the <br />percentage of the vote to which the holders of an interest are entitled is <br />the percentage assigned to the unit or units in the Oeclaration. In the <br />event more than one person has an interest in a unit, such holders shall <br />designate the holder of an interest entitled to vote and the percentage <br />vote may not be split. Such designation shall be made to the Secretary <br />prior to the meeting. Any dispute between or among several owners of a <br />unit regarding the execution of a designation of the holder of an interest <br />in title to vote, or who is the person to cast the vote allocated to that <br />unit, shall be decided by the Board of Directors. No vote shall be deemed <br />to inure to any unit during the time the holder of an interest in any unit <br />is the ~ssociation. <br /> <br />Section 2.2 Majority of Members. As used in these Bylaws, the term <br />"majority of members" shall mean those holders of an interest holding <br />fifty-one percent (51%) or more of the votes in accordance with the <br />. percentages assigned in the Declaration. <br />
