<br />.'-..,./ ! i <br /> <br />a:..., <br />~ ~, ~ <br /> <br />RESOLUTION NO.84-125 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PRELIMINARY PLAT <br />PL-138 FOR WATER RIDGE PLAZA. <br /> <br />WHEREAS, an application for a preliminary plat PL-138 has <br />been made by CBA Residential Development and Cimarron Capital <br />Corporation to plat a mixed use development generally along lOth <br />Street NW between 1-694 and the Lakeview Apartments and along <br />9A Avenue NW; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a preliminary plat was filed with <br />the City on June 14, 1984. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a pUblic hearing on June 19, 1984 <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />3. That the Planning Commission continued the public hearing <br />and that all persons present at the continued hearing on <br />July 17, 1984 were given an opportunity to be heard. <br />4. That the developer requested and was granted a continua- <br />tion of the July 17,1984 publiC hearing to August 21, <br />1984 at which time all persons present on August 21, 1984 <br />were given an opportunity to be heard. <br />5. That such application was reviewed by the City Council on <br />August 28, 1984 and the written comments and analysiS of <br />the City staff and the Planning Commission minutes and <br />recommendation were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to PL-138; <br /> <br />1. That the property has been recommended for rezoning from <br />R-l, Single Family Residential to R-3B,Multiple family <br />residential and from R-2,two family residential to B-3, <br />General Business. <br />2. That the preliminary plat meets the subdivision require- <br />ments of Chapter 26 of the City Codes and zoning code <br />requirements of the proposed zoning districts; and <br />3. That the proposed subdivision is consistent with surround- <br />ing subdivisions. <br /> <br />BE IT FURTHER RESOLVED that the application PL-138 t~ and hereby <br />approved subject to the following conditions: <br /> <br />1. Approval of rezoning, R-126. <br />2. Approval of Comprehensive Plan Amendment. <br />3. Approval of site plans, LP-160 and LP-161. <br />4. Approva 1 of PRD-40. <br />5. Approval by Ramsey County for curb cuts and lOth Street <br />right-of-way dedication. <br />6.
