<br />4 <br /> <br />( <br /> <br />RESOLUTION NO. 78~8 <br /> <br />NEW BRIGHTON PLANNING COMMISSION <br />BOARD OF REVIEW <br /> <br />RESOLUTtON MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF <br />NON-CONFORMING USE PERMIT APPLICATION, NC-28 <br /> <br />WHEREAS, an application for a non-conforming use permit NC-28 <br />has been made by John F. Lange to permit the construction of a <br />building addition on property located at 1211 Old Highway #8, and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a non-conforming use permit <br />NC-28 was filed with the City on March 15, 1978. <br /> <br />2. That the Board of Review heard and reviewed the <br />application at its meeting of March 21, 1978. <br /> <br />3. The written comments and analysis of the city Planner <br />and all person's statements made at the Board of <br />Review meeting were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Board of Review that the <br />following findings of fact are made in respect to NC-28: <br /> <br />1. That the following Type IV non-conformities exist on <br />the property: <br /> <br />A. There is no concrete curbing along the driveway <br />in the front yard. <br /> <br />B. The front yard is used for parking which is not <br />permitted in an industrial district. <br /> <br />C. The entire, front yard- is not landscaped. <br /> <br />- <br />D. The-e~isting build~ng has less ~thanthe required <br />15 foot side yard setback. <br /> <br />2. That site and landscape plans submitted indicate the <br />fOllowing in respect to the non-conformities: <br /> <br />A. ,The driveway servicing the site will have the <br />required curbing. <br />
