That the large road right-of-way creates a unique <br />circumstance and undue hardship in the re-use of this <br />property for this particular use. <br /> <br />5. That the proposal is consistent with the intent of the <br />zoning code as the building is actually set back further <br />from the paved portion of the street than would normally <br />be expected. <br /> <br />6. That the non-conformities are being reduced to the <br />greatest practical extent. <br /> <br />BE IT FURTHER RESOLVED, that the application for NC-29 is <br />and hereby approved subject to the following conditions: <br /> <br />1. Conformance with site and landscape plans dated <br />1978, signed by the applicant and City Planner. <br /> <br />2. That the apartment units be reduced from 10 units to <br />7 units. <br /> <br />3.
