W. -3 <br />ew <br />Vrighton <br />December 5, 1980 <br />William Dircks <br />Berger Transfer and Storage <br />3720 NE Macalaster Drive <br />St. Anthony, Minnesota 55422 <br />RE: Irrevocable Letter Of Credit <br />Dear Mr. Dircks: <br />The City of New Brighton issued a temporary certificate of <br />occupancy for your new warehouse building within the City <br />of New Brighton. This certificate permits the occupancy <br />of the building and provides a 9 month period for the <br />completion of the required site work. <br />The temporary certificate of occupancy is only issued upon <br />the receipt of a bond or irrevocable letter of credit cover- <br />ing the amount in dollars of the site work to be completed. <br />Belair Commercial Corporation posted an irrevocable letter <br />of credit for $50,000 and this letter was released by the <br />City on the request of the Belair Corporation. <br />This letter is requesting that Berger Transfer and Storage <br />post the necessary letter of credit for $50,000 to avoid <br />nullifying the temporary certificate of occupancy. The <br />letter is to cover the following items: <br />1. Completion of paving and landscaping as approved <br />under LP-78 stage I; <br />2. Compliance and installation of measures required <br />by t-he Rice Creek Watershed District; <br />3. The posting and stripping of no parking on the <br />northeast corner of the building adjacent to the <br />sprinkler connection. <br />The City must require the receipt of the letter of credit <br />within 10 days because the temporary Certificate of Occupancy <br />has already been issued. I should also note that the <br />issuance of that Certificate was based on the good faith that
