<br />~ <br /> <br />~ <br /> <br />l <br /> <br />RESOLUTION NO 84-108 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br />PRELIMINARY PRD-41 AND PRELIMINARY PL-139 FOR ROBIN WOODS <br /> <br />WHEREAS, an application for preliminary planned residential <br />development (PRD-41) and preliminary plat (PL-139) has been made <br />by James W. Senden to permit construction of 10 single family <br />zero-lot-line homes. <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for preliminary PRO and preliminary <br />plat was filed with the City of New Brighton on July 1, <br />1984. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on July 17, 1984, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />3. That such application was reviewed by the City Council on <br />August 14, 1984. <br />4. The written comments and analysis of the city staff, the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to PRD-41 <br />and PL-139: <br /> <br />1. That the property is zoned R-l, Single Family Residential. <br />2. That the preliminary plat is consistent with the sub- <br />division regulations contained in Chapter 26 of the New <br />Brighton City Code. <br />3. That the proposal is consistent with the stated purpose <br />and principles of the PRO provisions as contained in <br />Section 7-010, and PRO standards as contained in Section <br />7-060. <br />4. That the PRO is consistent with the existing zoning and <br />goals of the Comprehensive Plan. <br />5. That the proposed development is compatible with the type, <br />density and bulk of surrounding land uses. <br /> <br />BE IT FURTHER RESOLVED, that the application is hereby <br />approved subject to the following conditions: <br /> <br />1. That prior to the issuance of building permits individual <br />unit plans shall be reviewed by the City Planner for <br />consistency with the approved PRO and such established <br />convenants and declarations. <br />2. That all association covenants and declarations be <br />submitted for review and approval by the City Attorney <br />and that individual and unique features as listed in the <br />applicants letter be included in the documents. <br />3.
