Section 5-550, <br />fences in business districts, of the New Brighton zoning code states <br />that fences erected in the front yard or in the street side yard of <br />a lot shall not exceed 3l feet in height and shall have at least 75 <br />percent of their verticle surface plane open when viewed from a point <br />perpendicular of that plane. U-Haul can pull a building permit to <br />install a fence per the above requirements. Such fence must be in- <br />stalled on or within the front property line. <br /> <br />The provision for fencing in the front yard, with 75 percent of the <br />verticle plane open, will not meet the screening requirements for <br />rental equipment as stated in Section 15-171 (a) (3) of the New <br />Brighton City Code. Therefore the display and outside storage of <br />rental equipment will not be permitted in front of the building. In <br />addition the approved plans for U-Haul, signed and dated by Leon M. <br />Buss, designates all outside storage at the rear of the site. This <br />area is screened as the code requires. <br /> <br />In addition to regulating the height and openness of a front yard <br />fence the zoning code also states every fence shall be maintained in <br />a condition of reasonable repair and shall not be allowed to become <br />and remain in a condition of disrepair or danger. The redwood in <br />the fence along the rear of the property has sustained damage over <br />the years to a point where it no longer acts as a screen.
