<br />,., <br /> <br />RESOLUTION NO.84-107 <br />STATE OF MINNESOrx- <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF <br />3RD STREET NW. <br /> <br />WHEREAS. the request is to vacate a portion of 3rd Street <br />NW described as the fOllowing: <br /> <br />1. That portion of 3rd Street NW described as the <br />north 30 feet of 3rd Street NW lying east of <br />5th Avenue NW and west of 1-35W. <br /> <br />WHEREAS. the procedural history of the application <br />is as follows: <br /> <br />1. That the City of New Brighton has initiated <br />the vacation of ,3rd StreetNW. <br />2. That the City Council. pursuant to pUblished <br />notices. held a public hearing on the vacation, <br />all persons present at the hearing were given <br />an opportunity to be heard. <br />3. The written comments of the City Staff were <br />considered. <br /> <br />WHEREAS. upon vacation of the above described public <br />right-of-way, public interest in the property will accrue <br />to the follOWing described property: <br /> <br />Lots 9, 10 , 1 1 , 1 2, 13 , 1 4 ,15 , 16 . 17 , 1 8 . 19 ,20.21 . and 22, <br />Block 12. First Addition to New Brighton, Ramsey <br />County. Minnesota and vacated alley and street accruing. <br /> <br />NOW THEREFORE BE IT RESOLVED that the New Brighton City <br />Council hereby finds that it is in the public interest to vacate <br />the above described public right-of-way and makes the following <br />findings of fact: <br /> <br />1. That the adjacent properties do not require the right- <br />Of-way for access. <br />2. That the south 30 feet of the original right-of-way <br />was previously vacated. <br />3 . T hat 3 r d S t r e e t N W i s u ni m p ro v e d and do e s not s e r v e <br />a publ ic purpose. <br />4. That there are no utilities within the right-of-way. <br />5.
