<br />~ <br /> <br />Report #79- 427 <br />June 20, 1979 <br /> <br />lor' <br /> <br />APPLICATION FOR NON-CONFORMING USE PERMIT AND BUILDING PERMIT <br />NC-39, LP-88 MacGILLIS & GIBBS COMPANY <br /> <br />PURPOSE <br /> <br />To review a request for a non-conformirig use permit and building permit <br />to construct a pole building at a site with existing Type IV non- <br />conformities. <br /> <br />BAC KGROUND <br />APPLICANT: MacGillis & Gibbs Company <br /> <br />lOCATION: <br />ZONING: <br /> <br />440 - 5th Avenue N.W. <br /> <br />1-2, Heavy Industrial <br /> <br />PRESENT USE OF THE PROPERTY: Pole yard <br /> <br /> <br />AREA OF SITE: Approximately 30 Acres <br /> <br />SIZE OF STRUtTURE PROPOSED: 2912 square feet <br /> <br />REGULATIONS AND DISCUSSION PERTAINING TO TYPE IV NON-CONFORMITIES: <br /> <br />(, <br />1,- <br /> <br />A. Section 3-60 of the New Brighton Zoning Code states that where <br />Typ~ IV non-conformities are present and proposed to continue, <br />expansion of existing structures or construction of new <br />buildings shall be a11~wed only upon permiS$ion of the City <br />Council. <br /> <br />B. Such permission may be granted only if one or more of the <br />following conditions are met: <br /> <br />1. The total number of non-conformities is reduced; <br />2. The impact of any non-conformities upon adjacent <br />"prem~ses is reduced to the greatest practical exte~t; <br />3. The extent of any non-conformity is reduced where <br />practical. <br /> <br />C. Existing Type IV Non-Conformities: <br /> <br />1. lack of required landscaping - Section 10-l20(g) indicates <br />that in any in~ustria1 district any front and/or side <br />yard bordering upon a street shall be landscaped and shall <br />not be used for parking. - <br />2. Lack of dustless surface - Section 12-045(e) states that <br />off-street parking and driving areas shall be provided <br />with a dustless surface. <br />3. Lack of concrete curbing - Section 12-045(e) industrial <br />developments are required to have concrete curbing iri <br />yards abutting streets. <br />4. Front yard parking - Section 10-120(g) and 12-030(c) <br />prohibits off-street parking in industrial districts in . <br />any side yard bordering upon a street. <br />
