<br />"'i <br /> <br />" <br /> <br />,~ <br /> <br />RESOLUTION NO. 84-102 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF NONCONFORMING <br />USE PERMIT, NC-63 TO ALLOW RECONSTRUCTION OF SILVER LAKE ESTATES. <br /> <br />WHEREAS, an application for a nonconforming use permit has <br />been made by Silver Lake Estates to permit the rebuilding of <br />Silver Lake Estates on a site with type IV nonconformities; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a nonconforming use permit was <br />filed with the City on July 2, 1984. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on July 17, 1984, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />3. That such application was reviewed by the City Council <br />on July 24, 1984 and that the written comments and <br />analysis of the City Staff and the Planning Commission <br />minutes and recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Planning Commission that <br />the following Findings of Fact are made in respect to NC-63: <br /> <br />1. That the site has the following Type IV nonconformities: <br /> <br />A. More than the allowed number of dwelling units. <br />B. Less than required number of offstreetparlqi:t:lg's.ta~ns, <br />C. Less than required 30 foot rear yard building setback. <br />D. Lack of continuous concrete curbing and striping. <br />E. Parking spaces within the front yard setback. <br />F. Less than required 10' side yard building setback. <br />G . Lack of h an die.a,pp e d par kin g s tal 1 s . <br /> <br />2. That the foundations exist from the tornadoe damaged <br />buildings and for the garages that do not meet the set- <br />back requirements. <br /> <br />3. That the applicant has done everything practicaJ to re- <br />duce the nonconformities by providing additional parking <br />spaces, adding handicapped parking, providing concrete <br />curbing and striping in the parking areas, and construc- <br />ting the new garage buildings along the west property <br />line within the required 10 foot side yard setback. <br />4. That consideration of the nonconformities at a future <br />date could be warranted if a nonconforming use permit is <br />requested in the future. <br /> <br />BE IT FURTHER RESOLVED that the City Council hereby approves <br />N C - 6 3 sub j e c t to a p pro val 0 f L P - 1 6 3 and t h at. .
