<br />.. 4 _.... <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />-- <br /> <br />RESOLUTION NO <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR NON-CONFORMING USE PERMIT~ NC-40 <br /> <br /> <br />WHEREAS, An ~pplication for a non-conforming use permit <br />entitled NC-40 has been made by Spotts International to permit <br />the construction of a building on a site with Type IV non- <br />conformities. <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. That an application for a non-conforming use p~rmit <br />NC-40 was filed with the City of New Brighton on <br />September 4, 1979. <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on September 18, <br />1979. <br />3. That the City Council ~ pursuant to published and <br />mailed notices~ held ~public h~aring on September 25~ <br />1979, all person's present at the hearing were given <br />an opportunity to be heard. <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED~ That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />NC-40. <br /> <br />1. That the site has the following Type IV non- <br />conformities: <br />a. lack of concrete curbing; <br />b. Front yard parking in an industrial site; <br />c. Driveways tn excess of 36 feet in width; and <br />d. More than the permitted 2 driveways. <br />2. That the site and landscape plan indicate that the <br />applicant is proposing to reduce the number and impact <br />of the existing non-conformities. <br />3. That the existing landscaping in the front yard well <br />exceeds the area normally required for landscaping. <br />4. That the front yard parking is screened from the <br />public right-of-way where practical. <br /> <br />BE IT FURTHER RESOLVED, That the application for NC-40 is <br />hereby approved subject to the following conditions: <br /> <br />1. That the applicant install concrete curbing on the <br />southern portion of the driveway in the southeast <br />corner of the property which would enclose the <br />proposed landscape area and said landscaped area will <br />have the appropriate plantings to screen the remaining <br />parking from the public right-of-w~y. <br /> <br />Adopted this <br /> <br />day of <br /> <br />~ 1979. <br /> <br />James W.
