<br />""'~ <br />"', <br /> <br />RESOLUTION NO <br />STATE OF MINNESOTA <br />COUNTY Of RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING fINDINGS Of FACT AND APPROVING APPLICATION <br />FOR NON-CONFORMING USE PERMIT, NC-41 <br /> <br />WHElEAS, an application for a non-conformin~ use permit <br />entitled NC-41 has been made by Northwestern Bell to permit <br />the construction of a metal storage building on a site with <br />Type IV non-conformities. <br /> <br />WHEREAS, the procedural history ,of the application is as <br />follows: <br /> <br />1. That an application for non-conforming use permit <br />was filed with the City of New Brighton on June 13, <br />1979. <br /> <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on June 19, 1979. <br /> <br />3. That the City Council, pursuant to published and mailed <br />notices, held a public hearing on July 10, 1979, all <br />person's present at the hearing were given an <br />opportunity to be heard. <br /> <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations <br />were considered. _ <br /> <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />NC-41: <br /> <br />1. That the site is located in a 1-2, Heavy Industrial <br />District. <br /> <br />2. That the following Type IV non-conformities exist on <br />the property: <br />a. Side street yard parking in an industrial district. <br />b. Standard concrete block as the exterior wall <br />treatment on a street side of the building. <br /> <br />3. That the applicant has done everything practical to <br />eliminate and reduce the existing non-conformities. <br /> <br />BE IT FURTHER RESOLVED, that the application for NC-41 is <br />hereby approved subject to the following conditions: <br /> <br />1.
