<br />. <br /> <br />LP-93, NC-41 <br />Page #2 <br /> <br />4) Lack of concrete curbing along driveways~ <br />(Section l2-060,a.) <br /> <br />In accordance with the conditions setforth in <br />NC-36, the applicant has done the following <br />to eliminate the non-conformities mentioned <br />above: <br /> <br />1 ) <br /> <br />2) <br />3) <br /> <br />Placed concrete curbing along the driveways <br />to the front building line; and <br />Removed the three parking spaces extending <br />into the front yard; and <br />Provided a 4 to 6 foot berm along 9th Avenue <br />S.W. to screen the outside storage of <br />material; and <br />Agreed that the concrete block wall facing <br />Old Highway #8 will remain painted. <br /> <br />4) <br /> <br />According to Section 3-60 of the New Brighton Zoning Code, where Type <br />IV non-conformities are present and are proposed to continue, new <br />construction shall be allowed only upon permission of the City Council. <br />Since the non-conformities of off-street parking on a~treetside in <br />an industrial district and of the exterior wall treatment along Old <br />Highway #8 are proposed to continue, theapp1icant must have approval <br />of a non-conforming use permit before a building permit can be issued <br />for the proposed building. <br /> <br />The applicant maintains that it would not be practical to change the <br />exterior wall treatment of the existing building and to relocate the <br />parking area. The applicant has however indicated that slats would <br />be placed in the existing chain link fence along the southwestern edge <br />of the property to better screen the outside stdrageof material. <br /> <br />In general~ the applicant eliminated and/or reduced the impact of <br />the existing non-conformities in the application for NC-36 with the <br />exception of providing additional scr~ening by slatting the chain <br />linke fence on the southwestern portion of the site. <br /> <br />The request for a building permit is for the construction of a 7,500 <br />square foot metal storage building. Also included in the request is <br />an extension of the existing bituminous surface with a turn around <br />loop provided, the relocation of the existing rail spur to the north- <br />ern boundary of the property and anew' loading dock (16' x 801) <br />adjacent to the relocated rail spur. With the exception of the <br />previously mentioned Type IV non-conformities~ the site and landscape <br />plans ~s su~mitted contain all necessary information and conform with <br />all zoning code regulations. <br />
