<br />~, <br /> <br />RESOLUTION NO <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR NON-CONFORMING USE PERMIT, NC-42 ' <br /> <br />WHEREAS, An application for a non-conforming use permit <br />entitled NC-42 has been made by Griffis Inc. to permit th~ <br />construction of an industrial building on a site with Type IV <br />non-conformities. ' <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. That an application for a non-conforming use permit, <br />NC-42 was filed with the City of New Brighton on <br />September la, 1979. <br /> <br />2. That such application was reviewed by the New <br />Brighton Planning Commission Board of Review on <br />September 18, 1979. <br /> <br />3. That the Ci ty Council, pursuant to pub1 i shed and <br />mailed notices, held a public hearing on October 9, <br />1979, all person's present at the hearing were <br />g i v e n an 0 p port un i ty to be h ear d . <br /> <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />NC-42: <br /> <br />1. That the site has the following existing Type IV <br />non-conformities: <br /> <br />a. Front yard parking on a site in an industrial <br />district. <br />b. Lack of a dustless surface on driving areas and <br />storage areas. <br />c. Driveways exceed 36 feet in width. <br />d. All outside storage is not screened from the <br />public right-of-way. <br />e. Equipment stored that exceeds 6 feet in height <br />is not setback as required. <br />f. Lack of concrete curbing along the driveways in <br />the front yard. <br /> <br />2. That the applicant has addressed the non-conformities <br />by proposing to install landscaping, concrete curbing, <br />pave the driving and parking areas in the front yard, <br />and reduce the number of front yard parking spaces. <br /> <br />3. That applicant does not intend on eliminating all the <br />existing non-conformities because the general operatio <br />of the business restricts the amount 6f landscaping <br />in the front yard. <br /> <br />4. That the proposal of the applicant will reduce the <br />extent and impact of the non-conformities on adjacent <br />properti es. <br /> <br />.. <br /> <br />.0 <br />
