After the <br />trucks are refinished they are taken to' the rear of the site <br />and stored unti,l the applicant's clients pick them up. <br /> <br />The applicant contends that because of the garage do~rs and the <br />area needed to maneuver the trucks and trailers the entire front <br />yard cannot be landscaped ~s required. As indicated by the <br />site and landscape plans the applicant is proposing to install <br />2 landscaped ,areas that a~e 251 x 40L. The only concrete <br />curbing on the site encloses these landscaped areas. In <br />addressing"the non~conformity of front yard parking the applicant <br />is restricting front yard parking. to 4 spaces in front of the <br />office building. All other parking will takep]ace in the rear <br />yard ~f the site. <br /> <br />The proposal of the applicant somewhat addresses the existing <br />n b n - con for m i tie s . ' Howe ve r, s t a f f fee 1 s t hat the rea read d'i t ion a 1 <br />means available to the applicant that are practical and ff <br />implemented would better meet the intentions of the non-conforming use <br />section of the zoning code. The landscaped areas should be <br />extended to the south to the paved roadway. The other areas in <br />the front yard that are not landscaped should be paved. The site <br />plan does not indicate the necessary parking spaces. The plans <br />should specifically indicate the areas for parking and the storage <br />of vehicles in the rear yard. The storage of vehicles is required <br />to be setback 15 feet from the property line adjacent to I-35W. <br />It shou)d also be noted that the planindicat~s that the parking <br />spaces are 9' x 18' . The zoning code requires that the spaces <br />be 91 x 20'. There is adequate room in both the front and rear <br />yard to extend the spaces to the required 2G feet. <br /> <br />In summary, with above staff recommendations adjusting the <br />applitant's .site and landscape plans, the application would meet <br />the intentions of the non-conforming use pe~mit by reducing the <br />impact 6f the existing non-conformities. <br /> <br />In regard t6 the building plans, they are complete and contain <br />all the necessary information. <br /> <br />STAFF RECOMMENUATION <br /> <br />Staff recommends that the Board recommend approval of NC-42 by <br />waiving the reading and adopting the atta~hed resolution with <br />conditions. <br />
