After 'the <br />trucks are refinished they are taken to the rear of the site <br />and stored until the applicant's clients pick them up. <br /> <br />Theapp1icant contends that beta use of the garage doars and the <br />area needed to maneuver the tfucks and trailers the entire front <br />yard cannot be landscaped as required. As i'ndicated by the <br />site and landscape plans the applicant is proposing to install <br />2 landscaped areas tbat are 25' x 40'. T~~ only concrete <br />curbing on the site encloses these landscaped areas. In <br />addressing the non-conformity of frbnt yard parking the applicant <br />is restricting front yard parking to 4 spaces in front 'of the <br />office building. All ~ther parking will take place in the rear <br />ya~dof the site. <br /> <br />The propo~al of the applicant somewhat addresses the existing <br />nan-conformities. However, staff feels that there are additional <br />means available to the applicant that are practical and if <br />implemented would better meet the intentions of the non-conforming use <br />section of the zoning code. The landscaped areas should be <br />extended to the south ,to the paved roadway. The other areas in <br />the front yard that are not landscaped should be paved. The site <br />plan does not indicate the necessary parking spaces. The plans <br />should specifically indicate the areas for parking and the storage <br />of vehicles in the rear yard. The stora~e of vehicles is required <br />to be setback 15 feet from the prop~rty line adjacent to I-35W. <br />It should also be noted that the plan indicates that the parking <br />spaces are 91 x 18'. The zoning code requires that the spaces <br />be 9' x 20'. There is adequate room in both the front ~nd rear <br />yard to extend the spaces to the required 20 feet. <br /> <br />In summary, with above staff recommendations adjusting th~ <br />applicant's site and landscape plans, the application would meet <br />the intentions of the non-conforming use permit by reducing the <br />impact of the existing non-conformities. <br /> <br />In regard to the building plans, they are complete and contain <br />all the necessary information. <br /> <br />STAFF RECOMMENDATION <br /> <br />Staff recommends that the Board recommend approval of NC-42 by <br />waiving the reading and adopting the attached resolution with <br />conditions. <br />
