<br />. . <br /> <br />LP-94, N-C-42 <br />Page #2 <br /> <br />WARRANTS FOR GRANTING NON-CONFORMING USE PERMIT: <br /> <br />Section 3-60 of the New Brighton Zoning <br />Code states that before a non-conforming <br />use permit can be granted one or more of <br />the following conditions must be met by <br />the application: <br /> <br />1. The total number of non-conformities <br />is reduced; <br />2. The impact of any non-conformity upon <br />adjacent ~remises is reduced to the <br />greatest practical extent; and <br />3. The extent of any non-conformity is <br />reduced where ,practical. <br /> <br />DEVELOPMENT PROPOSED BY THE APPLICANT TO ADDRESS THE NON- <br />CONFORMITIES: <br /> <br />1. Installing two landscaped areas in the <br />front yard. <br />2. Surrounding, the landscaped areas with <br />concrete curbing. <br />3. Paving all areas of the front yard not <br />used for landscaping. <br />4. Reducing the number of parking spaces <br />in the front yard. <br />5. Moving the-outside storage of vehicles <br />to meet setback requirements and <br />storing these vehicles in an orderly <br />manner. <br /> <br />The applicant is proposing to construct a 6000 square foot service <br />building in the rear yard of the site. The primary operation of <br />this firm is the painting and refinishing of semi-truck cabs. The <br />existing buildings excluding the office building along County Road <br />D have overhead doors which are used in order to get the trucks <br />that have been refinished out of the buildings. After the trucks <br />are refinished they are taken to the rear of the site and stored <br />until the applicant's clients pick them up. <br /> <br />The applicant contends that because of the garage doors and the <br />area needed to maneuver the trucks and trailers the entire front <br />yard cannot be entirely landscaped as required. As indicated by <br />the site and landscape plans the applicant is proposing to install <br />2 landscaped areas that are 25' x 40'. The only concrete curbing <br />on the site encloses these landscaped areas. In addressing the <br />non-conformity of front yard parking the applicant is restricting <br />front yard parking to 6 spaces in front of the office building. <br />The proposed landscaped areas are not only designed by the applicant <br />to allow maneuvering space for the trucks but also to provide <br />screening of the front yard parking. <br />
