LP-94, NC-42 Page #4 Chairman Schmidt reported to the applicant that if all the non- conformities at the site are not eliminated, the applicant in order to meet the standards for a non-conforming use permit should reduce the extent or impact of the non-conformities. With the front yard parking the area should be paved. Motion by Schmidt, second by Lang to recommend approval of NC-42 by adopting a resolution with the following conditions: '1. That the proposed landscaped areas be extended to the paved roadway; 2. That the site plan be revised to indicate the necessary parking spaces with the required deminsions and to depict the location of the stored vehicles; and 3. That all areas not used for landscaping south of the north 1 i ne of .the 1 andscapi ng areas be paved and the remaining areas in the front yard be oiled. Commissioner Baker noted that the entire area used for parking should be paved. Motion by Baker, second ,by Livingston to amend the motion to amend the third condition to state that those areas used as parking and driving areas for cars should be pqved. 1 Aye (Baker) - 4 Nayes, amendment fails. 3 Ayes - 2 Nayes (Baker, Livingston), motion fails. Motion by Livingston, second by Baker to reconsider NC-42. 5 Ayes - 0 Nayes, motion carried. Motion by Livingston, second by Baker to recommend approval of NC-42 by adopting the resolution with the third condition being that the front yard be paved except those landscaped areas. 2 Ayes - 3 Nayes (Schmidt, Lang, Sande), motion fails. Motion by Schmidt, second by Sande to send NC-42 to the Council without a recommendation. 5 Ayes - 0 Nayes, motion carried.
