Box 2159 <br />Dallas, Texas 75221 <br /> <br />Dear Mr. McGee <br /> <br />I am writing to follow up our meeting of January 11,' 1989. To <br />avoid any misunderstanding, I would like to further clarify the <br />City's setback requirements as they pertain to the Fina site (see <br />attached site plan A). As I applied the City's new parking <br />standards to the Fina site, I discovered off-street parking areas are <br />now required to be setback 25 feet from all residential districts. <br />This additional setback requirement will not effect the amount of <br />buildable area on the subject site, but will reduce the amount of <br />site area which can be used for off-street parking. <br /> <br />I've sketched a concept site plan which serves as an example of how <br />the Fina site might be designed using current standards (see <br />attached site plan B). Said plan would require a front yard setback <br />variance and reduced street sideyard setback to allow for <br />maneuvering area around the westerly pump islands. Of course, the <br />provision of a full 30 foot setback for your maneuvering area would <br />eliminate the need for a setback variance and thus make your <br />proposal more acceptable. Please be advised, I am not promoting <br />the sketch I prepared nor am I assuring its approval. All site <br />plans are subject to Planning Commission and City Council review <br />and approval. <br /> <br />Finally, since the Fina site does not presently comply with the <br />required 30 foot off-street and maneuvering area setback, it is <br />considered a type IV non-conforming use. If a 30 foot setback for <br />parking and maneuvering is provided on the new site plan, a non- <br />conforming use permit would not be required. However, if a <br />setback of less than 30 feet is provided, you would be required to <br />reduce the non-conformity to the greatest extent practical. In other <br />words, you would want to provide as large a setback as possible. <br /> <br />I am also enclosing a variance and a non-conforming use permit <br />application form should they be necessary. Please note, a variance <br />and non-conforming use permit require a public hearing, thus an <br />abstractor's certified list of property owners within 350 feet of the <br />site must be submitted along with your application. <br />
