Condominium As~ciation
10 Windsor Court
Box 129
New Brighton, MN 55112

Representatives of the Birch " Pond Condo Association have had an opportunity to
~ine the proposed plans of Fina Oil and Chemical Company for construction of a
/9"(3.sstationandconvenience store at Silver Lake Road and County Road E.

Tb,eresidentsof Birch Pond own ptopertYbordering on two sides of the proposed
site and have previously expressed concern about the groundwater run-off onto our
property as well as noise and dust polution. The proposed plans do not clearly
"indicate the nature of the landscape protection that will exist after the ,
,."coristruction.,We have several items that we believe require change or further
explanation:

Plans indicate a 6-foot wood fence is to be built along the two sides
bordering on Birch Pond., We request that a 2-footberm be the base for
such fence in order to prevent run-off down the steep grades adjacent
to thefehce~.

not clear as to the new ground levels along the southern
after the new construction. HmV' will the grade be
protected and at1V'hat level will the wood fence be' erected? Will the
fence be so low as to be of no value for screening?

The number of trees planted and the area covered appear far too small
to satisfactorily scr~n the area.

We trust that an Inventory Monitoring System "Till be required to detect
. gasoline leaks, that lighting be directed downward only, and that loud
speakers, if used, will not pertni t sound to go beyond the property.

Mr." Wally Uglem 'will represent the Owners I Association at Birch Pond in this matter
and we would )'1ppreciate your keeping him informed on this proposal. His telephone
number is 631-0793.

~.ur.s:~:... Y.' /_
,.....:W.P~

Glenn W. Pederson
president
