<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />October 9, 1990 <br /> <br />Page 6 <br /> <br />Council Business, continued <br /> <br />The City is required to proceed with acquisition if the estimated non- <br />reimbursable remediation costs are no more than $10,000 (Poshek agreed <br />to share in $5,000 of the costs). The City will disconnect municipal water <br />service and pay for property taxes due from October 10 to December 15. <br /> <br />Poshek's tanks are registered with the MPCA so 90% of any remedial <br />investigation and clean-up costs are reimbursable through the Petrofund. <br />The City pays for the tests upfront and then is reimbursed by Petrofund. <br /> <br />Jeanette Janecek, Poshek's attorney, acknowledged that the costs were <br />unanticipated. Janecek said the prorated property tax amount will be <br />$900, and the two months of interest will be $2,500. <br /> <br />Terracon's report will be completed before the December 15 closing. <br /> <br />Benke noted that the City had anticipated some problems, given the <br />history of the site, before considering acquiring the property. <br /> <br />Motion by Williams, seconded by Larson, to AUTHORIZE COMPLETION OF <br />A REMEDIAL INVESTIGATION ON THE PROPERTY AT 875--5TH AVENUE <br />NW AND EXTEND THE PURCHASE AGREEMENT WITH JOE POSHEK TO <br />ALLOW A CLOSING DATE OF DECEMBER 15, 1990. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Motion by Williams, seconded by Larson, to SCHEDULE A NOVEMBER <br />7TH SPECIAL COUNCIL MEETING FOR THE PURPOSE OF CANVASSING <br />ELECTION RESULTS AT 5:30 P.M., CITY HALL, SOUTH CONFERENCE <br />ROOM. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Announcements and Updates <br /> <br />Brandt Rebelein said the Environmental Quality Commission (EQC) has <br />requested Council to consider referring potential redevelopment projects to <br />the EGC for its review and recommendations.
