WHEREAS, an application for PL-211 and PRO-58 has been made by Rottlund Company; and

WHEREAS, the procedural history of the application is as follows:

1. An application for PL-211 and PRO-58 was filed with the City of New Brighton on
April 1, 1 994.
2. The Planning Commission, pursuant to published and mailed notices, held a public
hearing on April 19, 1994, and May 17, 1994, and all persons present at the
hearing were given an opportunity to be heard.
3. The City Council considered PL-211 and PRO-58 on May 24, 1994.

:!
,
!j
i I Now, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact in
I i respect to PL-211 and PRO-58:
Ii
Ii
,I
Ii
:,
;1

Ii
Ii
!i
ii
II
I.
;1
I
I
I
,
ii
'i
I
I
!
I
I
i
,
,I
II
!!

;i

1. The subject site is zoned B-4, Downtown Business.
2. The B-4 district recognizes the unique character and circumstances of the
downtown area and in order to create a harmonious and attractive development
pattern allows for flexibility in the application of the Zoning Ordinance standards
and requirements.
3. The proposed 74 unit townhouse development is being processed as a Planned
Residential Development (PRO).
4. The PRO Ordinance encourages flexibility in the enforcement of the Zoning
Ordinance density and setback requirements if it can be shown by the applicant the
development would encourage social interchange, life-cycle environment, and
efficiency in the use of land without creating a detriment to public health, safety,
morals, or general welfare.
5. The proposed 74 unit townhouse development would be harmonious with existing
and developing land uses in the downtown area and would improve the aesthetics
of the downtown area through new residential structures and landscaping that
would compliment the proposed 5th Avenue NW streetscape and landscaping plan.
6. The proposed preliminary PRO and Preliminary Plat would comply with the B-4
district/PRO standards and with the Chapter 26 Subdivision standards.

BE IT FURTHER RESOLVED, the application for PL-211 and PRO-58 is hereby approved subject
to the following condition:

1.
