Proper noted that the City will <br />attempt to preserve the trees which border the sidewalk area. <br /> <br />Mel Borner, Woodland Hills, verified that a majority of area <br />residents endorse the sidewalk project. <br /> <br />There were no further comments from the audience. <br /> <br />Moti on by Gunderman, seconded by Wi 11 i ams, to CLOSE THE PUBLIC <br />HEARING. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Motion by Williams, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION ORDERING CONSTRUCTION OF THE SIDEWALK ON COUNTY <br />ROAD E BETWEEN STINSON BOULEVARD AND SILVER LAKE ROAD. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />I <br /> <br />Council Business <br /> <br />Proper presented supplemental information to the Lake Sedimentation <br />report. <br /> <br />Representat i ves of the (Department of Natural Resources) DNR and <br />(Rice Creek Watershed District) RCWD have been contacted and neither <br />agency had problems with the preliminary report. Permits may be <br />needed from the DNR and RCWD for certain proj ects and woul d be <br />determined at the feasibility study stage for each project. <br /> <br />The DNR did not feel the term "small private bodies" to identify <br />1 akes, ponds and wetl ands, waul d create any problems. The DNR 's <br />terminology uses "unprotected basins" for less than 2 1/2 acres and <br />"protected basins without public access II for over 2 1/2 acres. <br /> <br />Several metro area cities were surveyed. Minnetonka, Fridley, and <br />Bloomington were found to have lake improvement policies. <br /> <br />City Attorney Charlie LeFevere reviewed the report and stated that <br />project costs coul d be speci a 1 assessed. Controvers i a 1 projects <br />where assessment appeals are expected, should be special assessed <br />before contracting for the work. <br /> <br />I <br /> <br />There was some discussion to the preparation of a policy draft which <br />would state maximum and minimum percentages of participation for <br />bodies of water without public access.
