<br />Page 2 <br /> <br />However. as the dust cleared after the session, it became evident to us and others. including <br />KEY LEGISLA TORS, that the legislation that did pass for us. DID ALLOW us to build our <br />project and the state must recognize our costs. We proceeded to get our interpretation of <br />the legislation confirmed by the approving State Agencies. At this point in time we have <br />set up a meeting with the main players in this decision making process and our attorneys. <br />We have increased our approach in resolving our issues and have put the State Agencies on <br />notice that we have other legal options and are seriously considering them. We will make <br />a decision on this issue after this final meeting with the State officials. <br /> <br />Today is September 29th and the property is almost cleared. As in other major projects. <br />delays are always a possibility. The importance of this or a similar project at the New <br />Brighton Care Center is extremely important to us and we believe. the community. <br />It has been in our best interest to pursue every option available to have this project's cost <br />recognized by the State. As long as we have a legitimate and worthwhile chance, we will <br />continue to pursue our goals. We have always had the option of building something similar <br />to our proposed project, without the need for State approval However, it is not our first <br />choice. <br /> <br />At this point in time I am awaiting a call from our attorney. He was setting up a face to <br />face meeting with the State Officials, at their request. This should take place within the <br />next two weeks. After that meeting, we will be making some important decisions as to the <br />NBCC project. The complete survey had been done a few weeks ago and has been <br />forwarded to our Architect for Site Plan preparation. The Architect had identified some <br />concerns with the most recently revised proposed property line. We hopefully will have <br />those issues worked out. <br /> <br />I have been making inquiries into the availability and lead times required for construction <br />supplies/products. I have been told that long lead times are currently required because of <br />shortages in steel and concrete products. The timing is becoming a concern. with winter <br />coming, it could pose a problem. with the cold weather not that far away. G-iven the <br />variables. we will plan on setting up a meeting with the City, shortly after our meeting with <br />the State officials. I am confident and excited that theNew Brighton Care Center's project <br />will be a reality. <br /> <br />If you have any questions or concerns that you would like to share with me, please do not <br />hesitate to call.
