<br />RESOLUTION No. 95-3 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />i. RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF AN APPLICATION FOR A <br />i! SPECIAL USE PERMIT SP-185. <br />!I <br />!I <br />11 <br />11 <br />II <br />II <br />Ij <br />I <br />I <br />I <br /> <br />WHEREAS, an application for a special use permit has been made by Tom Thumb Food <br />Markets, Inc., to allow for gasoline sales in conjunction with an existing convenience store. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. <br /> <br />An application for a special use permit, SP-185, was filed with the City of New <br />Brighton on December 29, 1994. <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on January 17, 1995, and all persons present at the hearing were given <br />an opportunity to be heard. <br /> <br />2. <br /> <br />Now THEREFORE BE IT RESOLVED, the Planning Commission makes the following Findings <br />of Fact in respect to SP-185: <br /> <br />1. The subject site is zoned B-2, Neighborhood Business. <br />2. The applicant is proposing to provide gasoline sales in conjunction with the existing <br />convenience store. <br />3. Gasoline sales are a special use in the B-2 district. <br />4. The proposed gasoline sales would not substantially increase the number of daily <br />trips to and from the subject site. <br />5. The relocation of the most westerly curb cut would allow for better sight lines and <br />. reaction time for motorists entering and exiting the subject site. <br />6. The establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, or comfort of the <br />general public. <br />7. The special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially <br />diminish and impair property values within the neighborhood. <br />8. The establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in <br />the district. <br />9. Adequate utilities, access roads, drainage and/or necessary facilities have been or <br />are being provided. <br />10. The special use shall, in all other respects, conform to the applicable regulations' of <br />the district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, the application SP-185 is hereby recommended for approval, <br />subject to the following conditions. <br /> <br />1 . Conformance and adherence to all standards for special use permits as pertains in <br />Section 8-110 and 8-130 of the New Brighton Building Code. <br />2.
