The proposed canopy would <br />require a 6 foot setback variance from the front property line. A nonconforming use permit is <br />required because the existing parking lot is also located six feet from the 6th Avenue NW <br />right-of-way. Site plan review is also required for the proposed canopy. <br /> <br />The front property line or the 6th Avenue NW right-of-way jogs as it runs along the subject site. <br />This jog of some 25 feet is what is causing the proposed canopy and existing parking lot to not <br />meet the required 30 foot frontyard setback. <br /> <br />Only a small section of the proposed canopy would violate the 30 foot setback requirement. The <br />unique circumstance would be the subject site's irregular right-of-way or front property line. <br /> <br />According to the applicant, the addition of gasoline sales would increase the number of customer <br />trips per day from 514 to 599 trips per day. the peak time for trips would be early morning, lunch <br />hour, and evening. the proposed 15% increase in daily trips should'be offset by the applicant's <br />proposal to eliminate the most westerly curb cut and move it further to the west to align with 6th <br />Avenue NW. This adjustment would also provide motorists with a better line of sight and reaction <br />time to vehicles traveling on Old Highway 8 or 6th Avenue NW. <br /> <br />The proposed development, as a whole, would improve landscaping along Old Highway 8 (with <br />the addition of deciduous trees) and improve access to and from the site. <br />
