<br />'{ <br /> <br />Page 2 <br /> <br />FINDINGS <br />· Section 8-010, Site Plan Review <br />· Section 8-310, Rezoning <br />· Section 4-210, R-2, Two Family Residential <br /> <br />PAST ACTION <br />· Following the adoption of the moratm:ium ordinance, the City Council considered the Silver <br />Oak Development exemption request and referred it to the Highway 8 Task Force. <br /> <br />· On December 11, 1996, the Highway 8 Task Force considered the request for exemption from <br />the moratorium ordinance for the Silver Oak Development site. The Task Force made a <br />recommendation to the Planning Commission the Silver Oak Development site be exempted <br />from the Highway 8 moratorium. <br /> <br />· On January 21, 1997, the Planning Commission considered the moratorium exemption for the <br />Silver Oak Development site and tabled consideration of the item until the March 18th <br />meeting or until the consultant rendered an opinion on the future development of said site. <br /> <br />· On February 18, 1997, the Planning Commission considered additional information from the <br />Highway 8 planning consultant regarding the moratorium exemption request, and <br />recommended the moratorium ordinance be amended to exempt the Silver Oak Development <br />property from the moratorium. <br /> <br />· On February 25, 1997, the City Council removed the subject site from the Old Highway 8 <br />moratorium. <br /> <br />· On March 18, 1997, the Planning Commission held a public hearing and recommended denial <br />ofR-141 and LP-315 (Vote: 5-2), based on: <br />1. THE REZONING REQUEST BEING INCONSISTENT WITH THE COMPREHENSIVE <br />PLAN'S LAND USE DESIGNATION OF SINGLE FAMILY RESIDENTIAL FOR THE <br />SUBJECT SITE; <br />2. THE REZONING OF THE SUBJECT SITE TO R-3B ALLOWS FOR A MORE INTENSIVE <br />DEVELOPMENT OF THE SITE THAN THE R-l DISTRICT WOULD AFFORD; <br />3. THE REQUESTED REZONING REPRESENTS A SPOT REZONING; AND <br />4. AN INCOMPLETE SITE PLAN SUBMITTAL; <br /> <br />· On March 25, 1997, the City Council continued consideration ofR-141/LP-315, to allow the <br />applicant time to amend the proposal and bring it back to the Planning Commission for their <br />reconsideration. <br /> <br />· On April 15, 1997, the Planning Commission considered the amended application for R-141 <br />and LP-315 and recommended approval (Vote: 4-1) <br /> <br />SITE CHARACTERISTICS <br />1.
