Locke will clarify the issue before the October 10th Report 89-233 <br />Council meeti ng. <br /> <br />Mayor Benke noted that the resolution for the subdivision should not <br />be acted upon until the ordinance for the rezoning has had its final <br />reading, inasmuch as the request is dependent on the property being <br />rezoned to B-1. <br /> <br />Motion by Brandt, seconded by Benke, tc CONTINUE ACTION TO THE <br />OCTOBER 10, 1989, COUNCIL MEETING ON THE RESOLUTION APPROVING THE <br />SUBOIVISION/PL-182 UNTIL THE ORDINANCE/R-135 FOR REZONING IS <br />ADOPTED. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Locke presented the request for a minor subdivision/lot width <br />variance for Mr. Warren Raiche. <br /> <br />The addresses of both parcels are 2951--16th Street NW and 2971-- <br />16th Street NW and are owned by Mr. Raiche. <br /> <br />A recent survey revealed that the garage on Parcel A has been <br />constructed four feet onto Parcel B. Mr. Raiche is propos i ng to <br />split 10.2 feet off of Parcel B and add it to Parcel A to bring the <br />structure on Parcel A into compliance with the district setback <br />requirements. The proposed Parcel B would adequately accommodate <br />the existing small house. <br /> <br />Because the house on Parcel A was constructed four feet onto Parcel <br />B, an undue hardship and a unique circumstance is evident, thereby <br />qualifying for a variance per City Code requirements. <br /> <br />The Planning Commission held a public hearing on September 19, 1989, <br />and recommends approval. <br /> <br />Benke asked if there are records indicating the year the garage was <br />built.
