RESOLUTION No. 97- <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF NC-108. <br />WHEREAS, an application for a nonconforming use permit has been made by Nutec Development. <br />WHEREAS, the procedural history of the application for a nonconforming use permit is as follows: <br />1. An application for a nonconforming use permit was filed with the City of New Brighton <br />on August 1, 1997. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on August 19, 1997, and all persons present at the hearing were given an <br />opportunity to be heard. <br />Now, THEREFORE BE IT RESOLVED, the Planning Commission makes the following Findings of Fact <br />in respect to NC-108: <br />1. The subject site is zoned B-2, Neighborhood Business. <br />2. The following Type IV nonconformities exist on the subject site (Ken's Market site): <br />a. The existing parking lot does not have concrete curbing. <br />b. The existing parking stalls are located up to the right of way lines of Cleveland <br />Avenue SE and County Road D . <br />c. The existing parking lot contains no parking aisles and allows for direct access from <br />the public way to the parking stalls. <br />3. The applicant proposes to reduce the nonconformities on the subject site by making the <br />following improvement: <br />a. Provide a landscaped 50 x 50 foot landscaped area at the SE corner of said site to <br />allow for better sight lines at the intersection of Cleveland Avenue SE and County <br />Road D. <br />4. The applicant has reduced the number of Type IV nonconformities on the subject site to <br />the greatest practical extent. <br />BE IT FURTHER RESOLVED, the application NC-108 is hereby recommended for approval, subject to <br />the following condition: <br />1. Provision of a detailed landscape plan for the subject 50 x 50 foot green space, to be <br />approved by the City Forester and City Council. <br />2.
