HEAD'S APPROVAL: Kevin Locke, Director of Community Development MANAGER'S REVIEW/RECOMMENDATION: No comments to supplement this report Comments attached EXPLANATION/SUMMARY (attach supplemental sheets as necessary) To consider an application for site plan review, nonconforming use permit, setback variance, and a minor subdivision, to construct a two story office building on an existing commercial site. PAST ACTION On Auguste 19; 1997, the Planning Commission held a public hearing and voted 3-3 to deny the application, and voted 3-3 to approve the application. Both motions failed due to a lack of a majority vote. No recommendation was forwarded to the City Council. The motion to deny was based on a lack of green space on the proposed site caused by the setback variance, and a lack of an adequate buffer to the north due to a holding pond being proposed for the 30 foot setback area to the north. RECOMMENDATION Motion to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTIONS APPROVING NC-108, 1,7N-315, AND P1-236, SUBJECT TO CONDITIONS. Motion to APPROVE LP-327, SUBJECT TO THE FOLLOWING CONDITIONS: 1) APPROVAL OF THE GRADING AND DRAINAGE PLAN TO BY THE CITY ENGINEER 2) RCWD PERMIT APPROVAL 3) EASEMENTS BE..ESTABLISHED FOR THE PROPOSED SANITARY SEWER LINE RELOCATION AND PROPOSED STORM WATER RETENTION, POND, AND 4) A BOND OR LETTER OF CREDIT BE SUBMITTED TO THE CITY TO COVER 100% OF THE COST TO INSTALL CURBING, PAVING, AND LANDSCAPING ON THE TECH PRO SITE, AND LANDSCAPING ON THE KEN'S MARKET SITE. 5) APPROVAL AND CONTINUING COMPLIANCE WITH NC-108, VN-315, AND PL-236.
