RESOLUTION NO. 98-040 <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING SUBDIVISION OF CERTAIN PROPERTY WITHIN THE CITY OF NEW BRIGHTON <br />(GENERALLY 5TH AVE. NW & COUNTY ROAD E-2, FORMER MACGILLIS & GIBBS SITE). <br />WHEREAS, the City of New Brighton has been requested to subdivide certain property in the City of <br />New Brighton, located west of Fifth Avenue NW and south of County Road E-2, as extended; and <br />WHEREAS, State Statutes require that if such property is located in municipalities that have adopted a <br />platting ordinance, approval of the municipality must be obtained before such subdivisions can be filed; <br />and <br />WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of property without <br />platting if certain criteria can be met. <br />NOW THEREFORE BE IT RESOLVED, the City Council of the City of New Brighton approves the <br />subdivision of the above-described property into the following described parcel: <br />Legal Description is attached as Exhibit "A". <br />BE IT FURTHER RESOLVED, the City Council of the City of New Brighton approves PL-245. <br />Adopted this 14th day of April, 1998. <br />&I CA <br />Margaret A. an, City Clerk <br /> <br />Robert J.
