RESOLUTION NO. 4 R _ n 6 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF A <br />RIGHT-OF-WAY LYING WITHIN THE PROPOSED COUNTY ROAD E-2 EXTENSION <br />AND ALSO VACATING THIRD STREET NW AND A PORTION OF SIXTH AVENUE NW, <br />ALL WITHIN THE PROPOSED PLAT OF BRIGHTON CORPORATE PARK III <br />WHEREAS, <br />The City of New Brighton owns the property adjacent to the streets and rights-of- <br />way to be vacated hereunder. <br />2. That the City Council, pursuant to published notices, held a public hearing on the <br />vacation, and all persons present at the hearing were given an opportunity to be <br />heard. <br />NOW, THEREFORE BE IT RESOLVED THE CITY COUNCIL OF THE CITY OF <br />NEW BRIGHTON makes the following Findings of Fact in respect to the proposed vacation: <br />The streets and rights-of-way to be vacated no longer serve a public purpose. <br />2. There are existing utility easements over all vacated streets and rights-of-way <br />which will be maintained. <br />BE IT FURTHER RESOLVED, the Council hereby vacates portions of Third Street NW <br />and Sixth Avenue NW described as follows: <br />That portion of Third Street NW and Sixth Avenue NW lying westerly of <br />the westerly right of way line of Fifth Avenue NW, easterly of the west <br />line of Sixth Avenue NW, southerly of the southerly line of Block 11, <br />First Addition to New Brighton, and northerly of the centerline of Third <br />Street NW, all within the recorded plat of the First Addition to New <br />Brighton, Ramsey County, Minnesota. <br />Also that portion of Third Street NW lying westerly of the westerly right <br />of way line of Fifth Avenue NTW, northerly of the north line of vacated <br />Block 5, plat of New Brighton, easterly of the easterly line of Sixth <br />Avenue NW projected northerly to the centerline of Third Street NW and <br />southerly of the centerline of Third Street NW, according to the recorded <br />plat of New Brighton, Ramsey County, Minnesota.
