HEAD'S APPROVAL: Kevin Locke, Director of Community Development <br />MANAGER'S REVIEW/RECOMMENDATION: <br />No comments to supplement this report Comments attached <br />REQUEST (attach supplemental sheets as necessary) <br />To hold a public hearing and consider a request to vacate a triangular shaped portion of County Road E2 Extension (legal <br />description attached) and the north half of 3rd Street NW (legal description attached), located in Brighton Corporate Park <br />III. <br />SUMMARY <br />In review of the plat of Brighton Corporate Park III, the County Surveyors office discovered that the north half of 3rd <br />Street NW has not yet been vacated. Additionally, it was discovered that a gap exists in the vacation of 5th Street (County <br />Road E2 Extension), due to an incorrect legal description. <br />Therefore, in order to accommodate the development of Brighton Corporate Park III, City staff is proposing to vacate the <br />north half of 3rd Street NW, and the triangular shaped "gap" of County Road E2. <br />RECOMMENDATION <br />Motion to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION VACATING THE TRIANGULAR SHAPED "GAP" <br />OF COUNTY ROAD E2 EXTENSION, AND VACATING THE NORTH HALF OF 3RD STREET NW, AS LEGALLY DESCRIBED, <br />SUBJECT TO THE FOLLOWING CONDITION: <br />1.
