HEAD'S APPROVAL: Kevin Locke, Director of Community Development <br />MANAGER'S REVIEW/RECOMMENDATION: <br />No comments to supplement this report- Comments attached <br />EXPLANATION/SUMMARY (attach supplemental sheets as necessary) <br />The City Council is asked to consider an application for a Site Plan review for Lakeview Business Center 6, which includes <br />the construction of a 48,000 square foot office/warehouse facility. <br />This item was continued from the January 26, 1999 City Council meeting in order for the applicant to respond to concerns <br />from the neighboring property to the north (Chenoweth's). Issues that have been raised by the Chenoweth's include: <br />Request for fencing along the lot line separating the two properties; Lighting potentially shining onto the Chenoweth <br />property; Trees on Old Highway 8 blocking view of the existing Chenoweth sign; The proposed building blocking out <br />sunlight into the green houses. Attached is a letter submitted by the Chenoweth's expressing their concerns. <br />In response to these concerns, John Allen of Industrial Equities, submitted a letter stating how the concerns would be <br />addressed (see attached letter). <br />The following highlights the issues: <br />Lighting: The proposed security lighting is located on the building. Per the lighting plan, at the Chenoweth property the <br />light is reduced to .17 foot candle. No direct light will be exposed at any lot line. The lighting plan meets the <br />City Code requirement. <br />Trees: Mr. Allen has agreed to locate trees so as not to effect the existing signage for Chenoweth's. The City Forester <br />reviewed the landscape plans, and recommended that the western most Pink Spire Crab and Colorado Spruce, <br />adjacent to the Chenoweth property, be eliminated from the plan to protect views of the Chenoweth sign (see <br />attached landscape plan. <br />Fencing: The City Code does not require fencing as part of a site plan review, therefore, it would be very difficult for the <br />City to require fencing in this instance, since the adjacent land is zoned for industrial uses. If the adjacent <br />property were zoned residential, then screening could be required. Mr. Allen has stated his reluctance to install <br />fencing. <br />Grading: The proposed grading plans are consistent with the overall grading plans approved for this area. Once the site <br />is final graded, the drainage problems should improve. <br />Sun Blockage: The New Brighton Zoning Ordinance does not regulate "sun rights". It simply regulates building setbacks <br />and height restrictions etc. In this instance, the proposal meets all City Code requirements including <br />setbacks and height restrictions. Therefore, it would be difficult for the City to deny a site plan based <br />upon blocking of the sun from the adjacent property. <br />Attached for your reference is the Planning Report from January 26, 1999.
