INC. FOR THE PURCHASE OF THE <br />PROPERTY AT 2011 COUNTY ROAD D. <br /> <br />3 Ayes - 0 Nayes, Motion Carried <br /> <br />Locke presented the consideration of a resolution authorizing <br />acquisition of title and possession to certain lands by eminent <br />domain. <br /> <br />This proposal is closely related to the previous authorization to <br />execute a purchase agreement with Hydro-Stream-Pipkorn Ltd., Inc. <br /> <br />FOi" New Bri ghton to fulfi 11 its ob 1 i gati on under the terms of the <br />deve 1 opment agreement, the City must acqu ire the site for the <br />project. The site includes two parcels owned by Hydro-Stream- <br />Pipkorn and one parcel owned by Frank Morrison. <br /> <br />A j'esolution authorizing use of the City's powers of eminent domain <br />is needed to insure that the City can acquire and gain clear title <br />to the site in a timely manner for the proposed development project. <br />The City has already negotiated the purchase of the Hydro-Stream- <br />Pipkorn property and would not use condemnation for its acquisition. <br /> <br />Includi ng the Pi pkorn property in the area to be condemned wi 11 <br />insure that gaps or other titl e probl ems whi ch may ari se can be <br />expeditiously resolved. <br /> <br />To date the City has been unable to negotiate the purchase of the <br />Morrison property and it may need to be acquired through <br />condemnation. The City will continue to attempt to negotiate the <br />purchase of the property. Authorization for condemnation does not <br />preclude a negotiated purchase.
