<br />1 <br /> <br />III <br /> <br />1 <br /> <br />Council Meeting Minutes <br />February 28, 1989 <br /> <br />Page 17 <br /> <br />Council Business, continued <br /> <br />The property owners of the Hydro-Stream-Pipkorn and D Rock Center <br />sites were present at the Council meeting but did not have further <br />questions or comments. <br /> <br />Motion by Larson, seconded by Benke to WAIVE THE READING AND ADOPT <br />THE RESOLUTION AUTHORIZING EXECUTION OF A DEVELOPMENT AGREEMENT WITH <br />INTERSTATE CENTRE DEVELOPMENT GROUP CONTINGENT UPON THE NEGOTIATION <br />OF A SATISFACTORY PURCHASE AGREEMENT WITH HYDRO-STREAM-PIPKORN LTD. <br />INC. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />With Council consent, Benke removed and deferred consideration of <br />Council Business Item #9, Consideration of Authorization to Execute <br />a Purchase Agreement with Hydro-Stream-Pipkorn Ltd. Inc. <br /> <br />Anne Norris, Community Development Specialist, presented the <br />Consideration of Resolution Authorizing Acquisition of Property by <br />Eminent Domain in TIF District #6. <br /> <br />The action will provide clear title to a group of gaps or portions <br />of parcels that were omitted from legal descriptions. Some of the <br />gaps occurred due to surveyors. errors, complications resulting from <br />auditor I s subdi vi si ons and some from hi ghway and street ri ght-of <br />way turnbacks. In order to convey the property in TIF #6, the City <br />must prOVide clear title to the property, including the gaps. <br /> <br />Benke asked if this process is the most expedient way to clear the <br />titles. Norris said the property owners involved have been notified <br />by the Ci ty of th is process, but 100% approval has not been <br />received.
